Article 1 – General provisions relating to these general conditions of sale (hereinafter the “GTC”)
1. 1. Object
The GCS are applicable exclusively to the online sale of products appearing on the site www.activecbd.eu , access to which is free and open to all Internet users.
1. 2. Scope
The T&Cs exclusively govern contracts for the online sale of products from Active CBD (Contrôles Bio Diagnostics) to customers and constitute with the online order the contractual documents opposable to the parties, to the exclusion of all other documents, prospectuses, catalogs or photographs of the products which have only an indicative value.
The T&Cs are exclusively applicable to products delivered to customers established in metropolitan France, in overseas territories, and/or in a member country of the EU.
The GCS are written, as well as all the contractual information mentioned on the site, in English.
1. 3. Availability and opposability of the T&Cs
The GCS are made available to consumers on the seller’s website where they can be consulted directly.
The T&Cs are enforceable against the customer who acknowledges, by ticking a box provided for this purpose, to have been aware of them and to have accepted them before validating the order.
The validation of the order by its confirmation is worth adhesion by the customer to the CGV in force on the day of the order whose conservation and reproduction are ensured by the professional seller in accordance with article 1127-2 of the civil code (former C. civ ., art. 1369-4).
1. 4. Modification of the T&Cs
Active CBD (Contrôles Bio Diagnostics) reserves the right to modify its T&Cs at any time.
In the event of modification of the GCS, the applicable GCS are those in force on the date of the order, a copy dated to date of which can be given to the customer at his request.
1. 5. Severability of the clauses of the GCS
The nullity of a contractual clause does not entail the nullity of the GCS, except in the case of an impulsive and decisive clause which led one of the parties to conclude the sales contract.
The temporary or permanent non-application of one or more clauses of the GCS by Active CBD (Contrôles Bio Diagnostics) does not constitute a waiver on its part of the other clauses of the GCS which continue to produce their effects.
Article 2 – Products
The products offered for sale are presented on the activecbd.fr site and accompanied by a description.
The photographs illustrating the products do not constitute a contractual document.
Consequently, Active CBD (Contrôles Bio Diagnostics) can not incur the slightest responsibility in the event of error or omission of any of these elements or in the event of modification of the said elements by the suppliers and/or publishers.
The mode of use of the product, if it is an essential element, is mentioned in the electronic catalog or at the latest on its delivery.
The products are offered and delivered within the limits of available stocks.
Legal guarantee of conformity and legal guarantee against hidden defects
Active CBD (Contrôles Bio Diagnostics) is the guarantor of the conformity of the goods with the contract, allowing the customer to formulate a request under the legal guarantee of conformity provided for in articles L. 217-4 and following of the consumer code or the guarantee of defects of the thing sold within the meaning of articles 1641 and following of the civil code. In the event of implementation of the legal guarantee of conformity, it is recalled that:
- The customer benefits from a period of 2 years from the delivery of the goods to act;
- The customer can choose between the repair or the replacement of the good, subject to the conditions of cost envisaged by the article L.217-17 of the code of consumption;
- The customer does not have to provide proof of the non-conformity of the goods during the 6 months in the case of second-hand goods or 24 months in the case of new goods, following the delivery of the goods.
In addition, it is recalled that:
- The legal guarantee of conformity applies independently of the commercial guarantee indicated below;
- The customer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code. In this case, he can choose between rescinding the sale or reducing the price in accordance with article 1644 of the civil code.
Commercial guarantee
The products sold are also covered by a commercial guarantee aimed at guaranteeing their conformity and ensuring the reimbursement of the purchase price, the replacement or repair of the goods. It does not cover defects caused by abnormal or faulty use or resulting from a cause unrelated to the intrinsic qualities of the products.
Article 3 – Price
The selling prices are indicated, for each of the products appearing in the electronic catalog, in euros all taxes included, excluding delivery and transport costs.
The selling price of the product is that in force on the day of the order.
All orders, whatever their origin, are payable in Euros.
Delivery and transport costs are mentioned before validation of the order and invoiced in addition except when the order exceeds a sum previously announced on the “Delivery and payment” page of the site www.activecbd.eu .
They are fixed on the summary of the order.
The total amount owed by the customer is indicated on the order confirmation page.
In case of promotion, Active CBD (Contrôles Bio Diagnostics) agrees to apply the promotional price to any order placed during the advertising period for the promotion.
Active CBD (Contrôles Bio Diagnostics) reserves the right to modify its prices at any time, while guaranteeing the customer the application of the price in force on the day of the order.
Article 4- Offer
The online sales offers presented on the site are reserved for customers residing in metropolitan France / overseas territories and/or in a member country of the European Union and for deliveries in these same geographical areas.
The online sales offers presented on the site are valid, in the absence of indication of a particular duration, as long as the products appear in the electronic catalog and within the limits of available stocks.
The acceptance of the offer by the customer is validated, in accordance with the double click process, by the confirmation of the order.
Article 5 – Obligations of the customer
The Customer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to place an order on the site.
Before placing an order on the site, the Customer can create a customer account. To this end, he must complete a form in the “My Account” section with the information concerning him, and he undertakes to provide exact information and not to usurp the identity of a third party or to modify his age.

Article 6 – Order

Your order will be shipped upon receipt of your payment. The contractual information is presented in French and will be subject to confirmation no later than the time of delivery.

Article 7 – Payment
The price of the products is payable in full after confirmation of the order.
7.1 Terms of payment
Payment is made online by credit card or bank transfer.
7.2. Payment security
Our site is subject to mandatory 3D secure and PCI DSS security systems.
7.3. Default of payment
In the event of non-payment of the full price within ten days, the contract will be considered automatically terminated.
Article 8 – Availability

Article 9 – Delivery and terms
9. 1. Delivery zone
Active CBD (Contrôles Bio Diagnostics) delivers all orders to mainland France and the territory of the European Union.
9.2. Delivery delay
Active CBD (Contrôles Bio Diagnostics) undertakes to deliver the products within the time indicated on the order validation page by the customer, namely:
- From 24 hours to 5 days in metropolitan France;
- From 3 days to 10 days in European Union countries;
The delivery time corresponds to the shipping time indicated on the product page to which is added the processing and delivery time.
The period runs from the total payment of the order.
The deadlines do not apply in the event of force majeure or fortuitous events.
9. 3. Shipping cost
Delivery costs are the responsibility of the customer, except when the order exceeds a previously determined amount.
9.4. Delivery terms
The products are delivered to the address indicated by the customer on the order form.
Delivery is made by:
- the direct delivery of the product to the customer by the carriers according to the size of the object;
- by home delivery;
- by pick-up at a pick-up point.
If the package is made available, it must be collected by the customer within fifteen days of the notice of availability.
In the absence of withdrawal within the period indicated, Active CBD may, after a formal notice from the customer, which has remained without effect, proceed with the withdrawal, automatically resolve the order. Delivery costs will not be refunded, and any return costs will be borne by the customer.
9.5. Product compliance
When the product is delivered to the address indicated, it is up to the customer to check the condition of the product delivered in the presence of the delivery person and, if necessary, to express reservations on the delivery note or on the transport receipt.
If the product does not conform to the order, the customer must send a complaint to the professional seller in order to obtain the replacement of the product or possibly the resolution of the sale.
9.6. Delivery and transfer of risk
The product, which is delivered to the customer by a carrier chosen by Active CBD, travels at the risk and peril of the seller. The risk is transferred to the buyer when he takes physical possession of the goods.
The risks of loss or damage to the goods are transferred to the customer when he or a third party he has designated takes physical possession of the goods, without distinction according to its nature.
9.7. Transfer of ownership
From the actual delivery, the ownership of the product is transferred to the customer.
9.8. Late delivery
If the delivery has not taken place within 30 days of the date of the online order, the customer may request a refund within 30 days.
This period does not apply in the event of force majeure.
9.9. Failure to deliver
The total failure to deliver entails the automatic cancellation of the sales contract and the reimbursement of the price paid, including delivery costs.
A delivery incident will not be considered as a failure to deliver.
Article 10 – Return & Refund Policy
Items provided by Active CBD (Contrôles Bio Diagnostics) are new and guaranteed against defects. All products sold benefit from the “satisfied or refunded” clause for 14 days from the date of delivery in accordance with the provisions of the Consumer Code, article L 121-21, provided that the product has not suffered from any damage and is in its original packaging.
The customer exercises his right of withdrawal in accordance with article L 121-21 of the Consumer Code within 14 days from receipt of the goods. This right is exercised by returning the product to Active CBD (Contrôles Bio D iagnostics), the return costs being borne by the customer. Reimbursement to the customer will be made by check or bank transfer within 14 days of receipt of the goods following the exercise of the right of withdrawal.
The customer can return the products to the following postal address:

Returned products must be new, unused, and where applicable in their original box. Any item returned soiled and/or damaged by the customer will not be taken back.

It is up to the customer to provide proof of this return.
The Customer will be reimbursed for his entire order, at the price invoiced, except for delivery costs, within 15 days of receipt by Active CBD (Contrôles Bio Diagnostics) of the returned order.
If the return is refused by Active CBD (Contrôles Bio Diagnostics) for the reasons set out above, the products will then be returned to the customer at the expense of the latter without the latter being able to demand any compensation or right to reimbursement, with the exception of the subsequent exercise of his rights. warranty on products sold.

Any total or partial representation of this site by any person whatsoever, without the express authorization of the company Active CBD (Contrôles Bio Diagnostics) is prohibited and would constitute an infringement sanctioned by the Intellectual Property Code.
The hallmarks of the company Active CBD (Contrôles Bio D iagnostics) and its partners, such as the domain names, trademarks, denominations as well as the logos appearing on the site are protected by the Intellectual Property Code.
Any total or partial reproduction of these distinctive signs made from the elements of the site without the express authorization of the company Active CBD is therefore prohibited.
Article 13 – Applicable law – Disputes
This contract is subject to French law and is written in French. In the event of a dispute, only the French courts are able to rule.
Article 14 – Confidentiality
Active CBD (Contrôles Bio D iagnostics) undertakes not to disclose to third parties the information that you communicate to it. This information is confidential and will only be used by the internal services of Active CBD (Contrôles Bio D iagnostics) with a view to processing your order and/or allowing you to benefit from promotional offers.
